Terms of Service

1. Acceptance of Terms

By accessing or using FlatHunt, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the service. These Terms constitute a legally binding agreement between you and Mikhail Mikhalev (sole proprietor, Einzelunternehmer), operating as FlatHunt, Bundesallee 195, 10717 Berlin, Germany.

2. Description of Service

FlatHunt is a discovery, aggregation, and monitoring platform for furnished housing. We help you browse and compare listings from multiple rental platforms and, if you choose to create an account, send Telegram or email alerts when new listings match your saved search criteria.

Important: FlatHunt is not a rental agency and does not own, manage, list, or rent any apartments. All rental transactions take place directly between you and the original listing platform or property owner. We are solely responsible for the discovery, monitoring, and notification features described herein.

3. AI-generated recommendations

FlatHunt may offer an optional AI Assistant. When you use it, you interact with an AI system that helps search and compare FlatHunt listings. AI-generated answers may be incomplete, inaccurate or outdated. You must verify availability, rent, deposit, fees, Anmeldung, amenities and other rental terms directly with the relevant provider or landlord before relying on them.

The AI Assistant is not a landlord, broker or representative of any provider. It does not submit applications, book accommodation or conclude contracts on your behalf. Recommendations are not legal, financial or immigration advice.

You must not send identity documents, payment credentials, sensitive information or other people’s personal data through the AI Assistant.

We may temporarily restrict or block AI Assistant access in case of abuse, attempts to circumvent usage limits, automated use without authorisation, or a threat to service security or stability.

Liability for the AI Assistant is governed by section 8. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory German or European law, including liability for intent, gross negligence, and injury to life, body or health.

4. Access Model

You may browse and use FlatHunt's search features without creating an account (anonymous use). Creating a free account is optional and may be required for certain features such as saved searches, favourites, and alerts.

FlatHunt is currently offered free of charge. We do not require payment to use the service as described in these Terms. We do not currently apply usage quotas, but we may introduce fair-use or technical rate limits later to protect service stability and prevent abuse. If we do, we will describe them in the product and, where material, update these Terms.

We may introduce optional paid features or subscription plans in the future. If we do, the applicable prices, payment terms, and cancellation or withdrawal rights will be shown clearly before any charge and reflected in an updated version of these Terms before any paid contract is concluded.

5. Eligibility and Accounts

  • You must be at least 18 years old to use FlatHunt.
  • If you create an account, you must provide accurate and complete registration information and keep it up to date.
  • You are responsible for maintaining the security of your account credentials.
  • One account per person. Creating multiple accounts is not permitted.
  • You may delete your account at any time through the account settings in the app or by contacting us at hello@flat-hunt.com.

6. Prohibited Conduct

You agree not to:

  • Use FlatHunt for any unlawful purpose or in violation of applicable law.
  • Attempt to gain unauthorised access to any user account or system component.
  • Scrape, copy, store, or redistribute listings data obtained through FlatHunt.
  • Interfere with or disrupt the platform, servers, or networks.
  • Use automated tools, bots, or scripts to access the service without prior written permission.
  • Impersonate another person or entity.

7. Disclaimer of Warranties

FlatHunt is provided "as is" and "as available" without warranties of any kind, express or implied. In particular, we do not warrant:

  • The accuracy, completeness, or timeliness of listing data.
  • That a listed apartment is still available on the original platform.
  • That your search will result in finding a suitable apartment.
  • Uninterrupted, error-free, or secure access to the service.

We make reasonable efforts to ensure listing data is current but cannot guarantee it. Always verify availability directly with the original rental platform.

8. Limitation of Liability

To the maximum extent permitted under German law, FlatHunt shall not be liable for indirect, incidental, special, or consequential damages (including lost rental opportunities or financial loss) arising from use of or inability to use the service.

For simple negligence, our liability is limited to typical, foreseeable damages arising from a breach of material contractual obligations (Kardinalpflichten). Where the service is provided free of charge, liability for simple negligence is further limited to the extent permitted by mandatory law.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, intent, gross negligence, or any liability that cannot be excluded under mandatory German consumer protection law.

9. Intellectual Property

The FlatHunt platform, brand, design, and software are owned by Mikhail Mikhalev and protected by applicable copyright and intellectual property laws. Listing data is aggregated from third-party sources and remains the property of those respective sources.

You may not reproduce, distribute, or create derivative works from any part of FlatHunt without prior written consent.

10. Third-Party Services

FlatHunt integrates with third-party services including Telegram, Google (for optional sign-in and, with consent, analytics), email delivery providers, and various rental platforms. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

If you choose to submit an enquiry for a partner listing through FlatHunt, we may forward the enquiry information you provide to the relevant partner accommodation provider. The partner provider is responsible for contacting you, handling the accommodation enquiry, and managing any booking or leasing process. FlatHunt does not act as a rental agency, landlord, or booking platform.

11. Modifications to the Service and Terms

We reserve the right to modify or discontinue any part of the service at any time. We will provide reasonable notice of significant changes. If you continue to use FlatHunt after updated Terms are posted, you accept the revised Terms.

12. Termination

We may suspend or terminate your account or restrict access immediately and without prior notice if you breach these Terms or if we reasonably suspect fraudulent, abusive, or illegal use. Upon termination, your access to account-based features ceases immediately.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law provisions. If you are a consumer, you also benefit from any mandatory protective provisions of the law of your country of residence that cannot be excluded by contract.

For disputes with business customers (Unternehmer), the exclusive place of jurisdiction is Berlin, Germany. For consumers, the statutory place of jurisdiction applies.

14. Consumer Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Language Versions

These Terms may be provided in multiple language versions. To the extent permitted by applicable law, the English version prevails in case of inconsistencies. Mandatory consumer protection provisions remain unaffected.
