Terms of Service - FlatHunt

1. Acceptance of Terms

By accessing or using FlatHunt, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the service. These Terms constitute a legally binding agreement between you and Mikhail Mikhalev (sole proprietor, Einzelunternehmer), operating as FlatHunt, Bundesallee 195, 10717 Berlin, Germany.

2. Description of Service

FlatHunt is an aggregation and monitoring platform. We track furnished apartment listings across multiple rental platforms and send you Telegram or email alerts when new listings match your saved search criteria.

Important: FlatHunt is not a rental agency and does not own, manage, list, or rent any apartments. All rental transactions take place directly between you and the original listing platform or property owner. We are solely responsible for the monitoring and notification service described herein.

3. Eligibility

You must be at least 18 years old to use FlatHunt.
You must provide accurate and complete registration information.
You are responsible for maintaining the security of your account credentials.
One account per person. Creating multiple accounts is not permitted.

4. Free Trial

New users receive a 24-hour free trial with full access to all platform features. No credit card is required to start the trial. The trial expires automatically; no action is needed to avoid being charged.

5. Paid Subscriptions

5.1 Plans and Pricing

After the free trial, continued access requires a paid subscription:

Weekly: €6.99 per week, billed weekly
Monthly: €16.99 per month, billed monthly
3 Months: €39.99 per 3 months, billed every 3 months

All prices are in EUR and are total prices (Gesamtpreise). FlatHunt is operated by a sole proprietor qualifying as a Kleinunternehmer under §19 German VAT Act (UStG); therefore, no VAT is charged and no VAT is shown separately.

5.2 Payment Processing

Payments are processed securely by Stripe, Inc. By subscribing, you authorise Stripe to charge your selected payment method. We do not store your full payment card details.

5.3 Auto-Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You will receive a reminder before each renewal. By subscribing, you agree to the recurring charges.

6. Right of Withdrawal (Widerrufsrecht)

If you are a consumer (Verbraucher) within the meaning of §13 BGB, you have the right to withdraw from this contract within 14 days without giving any reason (statutory right of withdrawal under §355 BGB).

The withdrawal period begins on the day the contract is concluded (subscription start).

Waiver of right of withdrawal for digital services: By clicking "Start free trial" or subscribing to a paid plan, you expressly request that we begin providing the digital service immediately. You acknowledge that you will lose your right of withdrawal once the service has been fully performed, or — for subscription services already commenced — that your right of withdrawal expires after 14 days in accordance with §356(5) BGB and EU Consumer Rights Directive Art. 16(m).

If checkout is completed on a third-party billing page (e.g. Stripe Checkout/Portal), the required withdrawal consent and acknowledgement are collected in that checkout flow. Where legally required, processing starts only after such explicit consent is obtained.

To exercise your right of withdrawal (within the applicable period), please notify us by email at hello@flat-hunt.com with a clear statement of your decision to withdraw. We will confirm receipt and process any refund due within 14 days.

7. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
No partial refunds are issued for unused time within a billing period, except where required by law or where the right of withdrawal applies (see section 6).
The free trial expires automatically. No cancellation is needed to avoid charges.

8. Prohibited Conduct

You agree not to:

Use FlatHunt for any unlawful purpose or in violation of applicable law.
Attempt to gain unauthorised access to any user account or system component.
Scrape, copy, store, or redistribute listings data obtained through FlatHunt.
Interfere with or disrupt the platform, servers, or networks.
Use automated tools, bots, or scripts to access the service without prior written permission.
Impersonate another person or entity.

9. Disclaimer of Warranties

FlatHunt is provided "as is" and "as available" without warranties of any kind, express or implied. In particular, we do not warrant:

The accuracy, completeness, or timeliness of listing data.
That a listed apartment is still available on the original platform.
That your search will result in finding a suitable apartment.
Uninterrupted, error-free, or secure access to the service.

We make reasonable efforts to ensure listing data is current but cannot guarantee it. Always verify availability directly with the original rental platform.

10. Limitation of Liability

To the maximum extent permitted under German law, FlatHunt shall not be liable for indirect, incidental, special, or consequential damages (including lost rental opportunities or financial loss) arising from use of or inability to use the service.

Our total aggregate liability for direct damages shall not exceed the amount you paid us in the 3 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under mandatory German consumer protection law.

11. Intellectual Property

The FlatHunt platform, brand, design, and software are owned by Mikhail Mikhalev and protected by applicable copyright and intellectual property laws. Listing data is aggregated from third-party sources and remains the property of those respective sources.

You may not reproduce, distribute, or create derivative works from any part of FlatHunt without prior written consent.

12. Third-Party Services

FlatHunt integrates with third-party services including Telegram, Stripe, and various rental platforms. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

13. Modifications to the Service and Terms

We reserve the right to modify or discontinue any part of the service at any time. We will provide reasonable notice of significant changes. If you continue to use FlatHunt after updated Terms are posted, you accept the revised Terms.

14. Termination

We may suspend or terminate your account immediately and without prior notice if you breach these Terms or if we reasonably suspect fraudulent, abusive, or illegal use. Upon termination, your access to the service ceases immediately.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law provisions. If you are a consumer, you also benefit from any mandatory protective provisions of the law of your country of residence that cannot be excluded by contract.

For disputes with business customers (Unternehmer), the exclusive place of jurisdiction is Berlin, Germany. For consumers, the statutory place of jurisdiction applies.

These Terms may be provided in multiple language versions. To the extent permitted by applicable law, the English version prevails in case of inconsistencies. Mandatory consumer protection provisions remain unaffected.

16. Consumer Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.

We are not obliged to and do not participate in any consumer dispute resolution procedure before a consumer arbitration board (Verbraucherschlichtungsstelle).
